Vulnerabilidade e paternalismo: uma reflexão bioética sobre o novo código de ética médica brasileiro

Abstract

The study presented here as Vulnerability and paternalism: a reflection on the new code of ethics in Brazil, aims to contextualize the last general revision of the code of ethics of Brazilian physicians before a brief account of the history of medicine in the world and in Brazil with some interfaces with medical ethics and through the analysis of some bioethical frameworks such as autonomy, beneficence, and vulnerability. For this purpose, we used specific objectives that focus on the analysis of personal relationships in their code of medical ethics and the evaluation proposed by Leonard Martin, focusing on the hegemony of kindness and its importance in relation to economic values, legal and scientific. For this analysis documents, we analyzed the resolution of the Federal Medical Council No. 1931 of September 17, 2009. The comparative analysis of codes of medical ethics 1988 and 2009 we have seen advances in favor of humalistic subject vulnerable, however, paternalism remains in their lines. Thus, despite advances, the constant dialogue with society should still be considered as a primary policy of medical for future revisions to the codified norms.
